Welcome to Atomic Pilates & Chiropractic. These Terms of Use ("Terms") govern your access to and use of our website at atomicpilateschiro.com and our services, including Pilates classes, chiropractic care, and related wellness services ("Services").
By accessing our website, registering for services, or purchasing a membership or trial, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.
We reserve the right to update these Terms at any time. Continued use of our website or services after changes are posted constitutes your acceptance of the updated Terms.

2. Eligibility
To use our services, you must:
• Be at least 18 years of age, OR
• Be a minor whose parent or legal guardian has provided written consent and agrees to be bound by these Terms on your behalf

By using our services, you represent and warrant that you meet these eligibility requirements. We reserve the right to refuse service to anyone at our discretion.

3. Health and Medical Disclaimer
IMPORTANT: Pilates classes and chiropractic services involve physical activity and hands-on treatment. Participation carries inherent risks. Please read this section carefully.

3.1 Medical Clearance
You are responsible for obtaining medical clearance from your physician before participating in Pilates classes or receiving chiropractic care if you have any known medical conditions, injuries, or concerns. We strongly recommend consulting with your healthcare provider if you are pregnant, have cardiovascular conditions, osteoporosis, recent surgery, or any other condition that may be affected by physical activity.

3.2 Disclosure of Health Information
You agree to accurately disclose all relevant health information on intake forms and to inform our staff of any changes to your health status. Failure to disclose relevant health information may increase your risk of injury and may affect the care we are able to provide.

3.3 Chiropractic Care
Chiropractic services are provided by licensed chiropractic physicians. These services are not a substitute for emergency medical care. If you are experiencing a medical emergency, call 911 immediately. Chiropractic care is not intended to diagnose, treat, cure, or prevent any disease or medical condition beyond the scope of chiropractic practice.

3.4 Pilates Instruction
Pilates instruction is provided for educational and wellness purposes. Our instructors are certified Pilates professionals, not licensed medical providers. Pilates instruction does not constitute medical advice or treatment. Always follow instructor guidance and communicate any discomfort immediately.

4. Assumption of Risk and Release of Liability
By participating in our services, you acknowledge and agree that:

• Physical exercise and chiropractic treatment involve inherent risks including muscle soreness, fatigue, and the possibility of injury
• You voluntarily assume all risks associated with participation in our services
• You release and hold harmless Atomic Pilates & Chiropractic, its owners, instructors, staff, and agents from any claims, damages, losses, or injuries arising from your participation in our services, except in cases of gross negligence or willful misconduct

A separate Informed Consent and Liability Waiver form will be provided and must be signed prior to your first class or chiropractic appointment. These Terms do not supersede that waiver.

5. Memberships and Trials
5.1 Trial Offers
Trial memberships are available to new clients only. Limit one trial per household. Trial periods begin on the date of your first class attendance. Trial offers may not be combined with other promotions or discounts.

5.2 Memberships
Membership terms, pricing, cancellation policies, and billing details are governed by the Atomic Pilates & Chiropractic Membership Agreement, which is a separate document provided at the time of membership enrollment. In the event of any conflict between these Terms and the Membership Agreement, the Membership Agreement controls.

5.3 Payments
All payments are processed through WellnessLiving. By providing payment information, you authorize us to charge your payment method for services purchased. All sales are final unless otherwise stated in our Membership Agreement or required by applicable law.

5.4 Class Cancellations and No-Shows
Class reservation and cancellation policies are communicated at the time of enrollment and are available upon request. We reserve the right to charge cancellation fees for late cancellations or no-shows as outlined in our studio policies.

6. Studio Policies and Code of Conduct
To ensure a safe and welcoming environment for all clients, you agree to:
• Arrive on time for scheduled classes and appointments
• Follow all instructor and staff directions
• Wear appropriate workout attire and grip socks for Pilates classes
• Disclose any injuries, health conditions, or limitations before class
• Treat all staff and fellow clients with respect
• Not use our facilities under the influence of alcohol or drugs
• Supervise any minors in your care at all times

We reserve the right to refuse service or remove anyone from our facility who violates these standards or whose behavior poses a risk to themselves or others.

7. Website Use
7.1 Permitted Use
You may use our website for lawful purposes only. You agree not to:
• Use our website in any way that violates applicable laws or regulations
• Transmit any harmful, offensive, or disruptive content
• Attempt to gain unauthorized access to any part of our website or systems
• Use automated tools to scrape, crawl, or harvest information from our website

7.2 Intellectual Property
All content on our website including text, images, logos, graphics, and videos is the property of Atomic Pilates & Chiropractic or its licensors and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works from our content without our express written permission.

8. Third-Party Services
Our website and services integrate with third-party platforms including WellnessLiving, GoHighLevel, Meta Platforms, and Google. Your use of these platforms is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of third-party services.

9. Limitation of Liability
To the fullest extent permitted by applicable law, Atomic Pilates & Chiropractic and its owners, employees, instructors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or website.
Our total liability to you for any claims arising from or related to our services shall not exceed the amount you paid us in the three months preceding the claim.

10. Indemnification
You agree to indemnify and hold harmless Atomic Pilates & Chiropractic and its owners, staff, instructors, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of our services, your violation of these Terms, or your violation of any rights of another party.

11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Utah without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of our services shall be resolved in the state or federal courts located in Salt Lake County, Utah.
We encourage you to contact us first to resolve any concerns. We are committed to addressing issues promptly and fairly.

12. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

13. Entire Agreement
These Terms, together with our Privacy Policy and any applicable Membership Agreement or informed consent forms, constitute the entire agreement between you and Atomic Pilates & Chiropractic regarding your use of our services.
